In other words, when an hourly rate is proposed by an enrolled network provider (subcontractor) for a resource, the rate is the total rate, and the Contractor is not permitted to add on the Firm Fixed Mark-up Percentage when billing the State. " How does sales tax, if applicable, factor into the Firm Fixed Markup Percentage? This may not be applicable today in Ohio, but what is legal precedent today can change during the term of the contract. Will the state of Ohio allow the MSP to pass through such taxes on top of the Firm Fixed Markup Percentage rate?

And if the subcontractor only has $1M/$2M in insurance, is it the state’s position that the prime contractor would be liable for difference in damages?

Question:   We are curious as to whether or not a Vendor Neutral Model is an absolute requirement for this bid. Might you give consideration to an alternate model in which Rose International serves as both MSP and Staffing Provider? Our Delivery-Centric MSP offering does just that while maximizing both cost savings and contractor quality. Secondly, Do you require the MSP to provide their own in-house VMS system, or will you allow the MSP to utilize a third-party VMS system?

Answer:   The State’s requirement for a Vendor Neutral Model as described in the RFP is firm and is not open to alternative approaches. Offerors may propose either an in-house VMS system or utilize a third-party VMS system. The RFP does not specify or require a specific VMS solution approach.
