Question:   While working on the revised Attachment 7 Cost Summary Excel sheet, the numbers that are being calculated for totals in line 48 and 49 seem inaccurate. Specifically, the number in line 48 (brought over from Tab 2 Future-Unpublished ) does not match the number represented as the total on Tab 2. The number being represented in line 49 as the "Total Not to Exceed Fixed Price" is double the Total being displayed in line 47 (Total). Is this correct?

Question:   Cost Summary Lines 41-43 are formatted in PERCENTAGES. Should that be reformatted in USD?

Answer:   As posted on June 10th to another inquiry, bidders need to list what % of total licenses they would charge the State based on total value of licenses of $100,000.00. (i.e. 6.5% entered would give a value of %6.5 would give the State a bid of $6,500.00. on $100,000.00)

Question:   Would the State be amenable to the following proposed language revision to the Limitation of Liability paragraph on page 25 of the ITB? Neither party will be liable for any indirect, incidental, or consequential loss or damage of the other party, including but not limited to lost profits, even if the parties have been advised, knew, or should have known of the possibility of such damages. Additionally, neither party will be liable to the other for direct or other damages in excess of the total amount paid by the State to the Contractor for the products or services giving rise to the claim, provided such limitation does not impose an unlawful indemnification obligation upon the State. The limitations in this paragraph do not apply to any obligation of the Contractor to indemnify the State against claims made against it, disclosure/breach of State data including personally identifiable information or State sensitive information, or for damages to the State caused by the Contractor’s negligence or other tortious conduct.

Question:   Would the State be amenable to the following proposed language revision to the Indemnity for Property Damage, Bodily Injury, and Data Breach paragraph beginning on page 24 of the ITB? The Contractor must indemnify the State for all liability and expense resulting from any third party claims of bodily injury to any person (including injury resulting in death), damage to tangible or real property, provided that such bodily injury, property damage, or disclosure/breach is due to the gross negligence or willful conduct of the Contractor, its employees, agents, or subcontractors. The Contractor will not be responsible for any damages or liability to the extent caused by the gross negligence or willful misconduct of the State, its employees, its other contractors, or its agents.
